Terms of Service

These Terms of Service ("Terms") govern your access to and use of FireBreath ("Service", "Platform", "we", "our", or "us"), a social media scheduling and publishing platform. By creating an account or using the Service, you agree to be bound by these Terms.

1. Service Description

FireBreath is a cloud-based platform that enables users to compose, schedule, publish, and analyze social media content across multiple platforms including Facebook, Instagram, X (Twitter), LinkedIn, TikTok, Bluesky, Threads, and Google Business Profile. The Service also provides AI-powered caption generation, media management, team collaboration tools, and API/MCP integrations.

2. Account Terms

To use FireBreath, you must:

  • Be at least 18 years of age or the age of majority in your jurisdiction
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Accept responsibility for all activity under your account
  • Notify us immediately of any unauthorized access

You may not create an account on behalf of another person or entity without authorization. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws, regulations, or third-party rights
  • Post or distribute content that is unlawful, defamatory, harassing, or fraudulent
  • Spam, send bulk unsolicited messages, or engage in deceptive practices
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service infrastructure
  • Use automated tools to scrape, mine, or extract data beyond authorized API use
  • Violate the terms of any connected social media platform
  • Upload malware, viruses, or other harmful code

You are solely responsible for the content you create, schedule, and publish through the Service. We do not pre-screen content but may remove content that violates these Terms.

4. Connected Social Accounts

When you connect social media accounts to FireBreath via OAuth or other authentication methods, you authorize us to access and interact with those accounts on your behalf, including publishing posts, reading analytics data, and syncing existing content.

You retain full ownership and control of your connected social accounts. You may disconnect any account at any time through the Service settings. Disconnecting an account revokes our access but does not delete content already published to that platform.

5. Intellectual Property

Your content: You retain all rights to the content you create and publish through the Service. By using FireBreath, you grant us a limited license to store, process, and transmit your content solely for the purpose of operating the Service.

Our platform: FireBreath, its design, features, code, and documentation are owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand assets.

AI-generated content: Captions and text generated by our AI features are provided as suggestions. You are responsible for reviewing and approving all AI-generated content before publication.

6. Subscription & Billing

FireBreath offers free and paid subscription plans. Paid plans are billed monthly or annually at the rates displayed on our pricing page. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis.

  • All fees are stated in USD and are non-refundable except as required by law
  • You may upgrade, downgrade, or cancel your subscription at any time
  • Downgrades and cancellations take effect at the end of the current billing period
  • We may change pricing with 30 days notice to your registered email

7. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to our data practices as described in the Privacy Policy.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may temporarily suspend access for maintenance, updates, or circumstances beyond our control. Scheduled maintenance will be communicated in advance when possible.

We are not liable for delays, failures, or errors in publishing caused by third-party platform outages, API changes, or rate limits imposed by social media platforms.

9. Limitation of Liability

To the maximum extent permitted by law, FireBreath and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

  • Loss of revenue, data, or business opportunities
  • Content published to incorrect accounts or at incorrect times
  • Third-party platform actions (account suspensions, content removal)
  • Service interruptions or data loss

Our total liability for any claims related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless FireBreath, its operators, employees, and partners from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

11. Termination

You may terminate your account at any time by contacting us or through the Service settings. We may terminate or suspend your access if you violate these Terms or for any other reason with reasonable notice.

Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after termination, during which you may request an export. After 30 days, your data will be permanently deleted.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of British Columbia, Canada, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Vancouver, British Columbia.
